The Appellate Authority upheld that classification.

Eicher Motors Ltd v. Superintendent of GST and Central Excise — Madras High Court, 2024 · 2024-01-23

Eicher Motors had deposited tax amounts into its electronic cash ledger before the due dates but filed GSTR-3B belatedly owing to transitional credit issues, and the department demanded interest under Section 50. The Madras High Court held that once the amount is credited to the Government via the electronic cash ledger by the due date, the tax liability stands discharged to that extent, and no interest is leviable merely because the return was filed late. This reasoning has since been followed by other High Courts.

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

What to do about it: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

A client paid me an advance. Do I raise an invoice or something else?
On receiving an advance, you issue a receipt voucher under Rule 50, not an invoice; the tax invoice follows when the service is actually supplied. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. SMS filing fails for a few common reasons. The message must come from the exact mobile number registered against an authorised signatory on the GST portal, the format must match precisely with single spaces, and all returns for earlier periods must already be filed since GST returns are sequential. It also fails if the return is not truly nil, for instance if an amendment or credit note is pending to be reported. If one number is registered for multiple GSTINs, each needs its own SMS. What is the difference between GSTR-2A and GSTR-2B, and which one should I follow?
GSTR-2A is a dynamic statement that keeps changing as suppliers file or amend their returns, so the same month's data can look different on different dates. GSTR-2B is a static statement generated on the 14th of each month, capturing supplier filings between cut-off dates, and it never changes afterwards. The law ties your ITC eligibility to GSTR-2B, and GSTR-3B auto-populates from it, so 2B is the statement to reconcile against for monthly claims. GSTR-2A remains useful for tracing when an invoice was actually uploaded, which helps in replying to departmental queries about earlier periods.
Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. For current periods, GST on CSR purchases, whether school furniture donated or medical supplies distributed, is a cost. I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B. Instead, you pay tax every quarter through statement CMP-08, due by the 18th of the month following the quarter, and file one annual return, GSTR-4, by 30 June following the financial year. The scheme is available for turnover up to Rs.1.5 crore for goods, with a separate 6 percent scheme for service providers up to Rs.50 lakh. Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
Are any goods exempt from GST when transported by a GTA?
Yes. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider.
