Availability of an alternative remedy is a matter of judicial discretion, not a rule of compulsion. The High Court's refusal to consider the matter was set aside.
Practical effect: A Chennai taxpayer with a clean legal issue, such as limitation or jurisdiction, can press for a writ remedy instead of the appeal route.

The Board explained how demand and penalty apply where invoices are issued without any actual supply. A person who merely issues such an invoice has no output tax liability under Sections 73 or 74, because there is no supply at all, but is liable to penalty under Section 122(1)(ii). A person who takes and utilises credit on such an invoice faces demand and penalty under Section 74, and a person who further passes on that credit is treated the same way.

Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.
What to do about it: This process produced the Kerala flood cess of 2019, the only State-specific GST cess so far, and set the template for how any similar Tamil Nadu levy would have to be approved.
