Eicher Motors Ltd v. Superintendent of GST and Central Excise — Madras High Court, 2024 · 2024-01-23
Eicher Motors had deposited tax amounts into its electronic cash ledger before the due dates but filed GSTR-3B belatedly owing to transitional credit issues, and the department demanded interest under Section 50. The Madras High Court held that once the amount is credited to the Government via the electronic cash ledger by the due date, the tax liability stands discharged to that extent, and no interest is leviable merely because the return was filed late. This reasoning has since been followed by other High Courts.
What it means for you: If cash was parked in your electronic cash ledger before the due date, contest any interest demand for delayed GSTR-3B filing on that amount.

CBIC clarified that where a manufacturer replaces parts or provides repair services free of cost during the warranty period, no further GST is payable because the value of the warranty was already included in the price of the original supply on which tax was paid. Consequently the manufacturer need not reverse input tax credit on such replacement parts. Where a distributor replaces parts from his own stock and is reimbursed through a credit note, the position was explained separately.
What to do about it: Manufacturers and dealers should not pay GST again on warranty replacements, and should resist ITC reversal demands raised on free-of-cost warranty issues.
Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018
The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.
What to do about it: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.
