The Board laid down the verification process for TRAN-1 and TRAN-2 claims filed during the court-directed special window. Jurisdictional officers must examine whether the claim was earlier filed, rejected or is the subject of litigation, obtain a report from the counterpart State or Central tax administration, and pass a reasoned order only after giving the taxpayer an opportunity of hearing. The circular fixes timelines for each stage and requires the order to be uploaded on the common portal.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. For most small businesses a corrected fresh application is faster than an appeal. ChennaiGST reviews the rejection reasons first and then recommends the quicker route for your case.
How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise.
