Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

Compensation cess on pan masala and tobacco shifted to retail sale price

Notification No. 2/2023-Compensation Cess (Rate), dated 31 March 2023 · 2023-03-31

Following the Finance Act, 2023 amendment to the Compensation Cess Act, the cess on pan masala, gutkha, chewing tobacco, zarda and similar products stopped being charged as a percentage of transaction value and became a specific levy computed on the declared retail sale price per unit, with effect from 1 April 2023. Pan masala, for example, moved from an ad valorem rate to a rate expressed as a proportion of retail sale price, a change designed to defeat undervaluation in the tobacco trade.

What it means for you: Tobacco and pan masala dealers must print and track retail sale price per pack, since the cess is now computed on that figure rather than the invoice value.

My workshop bills customers for spare parts and labour together. How should GST be charged?
The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. Since auto components also moved to 18% from September 2025, both lines of a typical job card now carry the same rate, which removes the old temptation to shift value between parts and labour. Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. What is the due date for GSTR-3B in Tamil Nadu?
For monthly filers, GSTR-3B is due on the 20th of the following month. On receiving an advance, you issue a receipt voucher under Rule 50, not an invoice; the tax invoice follows when the service is actually supplied. GST is payable on advances received for services in the period of receipt, and the receipt voucher documents that liability. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. If the rate is not determinable when the advance arrives, tax is paid at 18 percent, and if the nature of supply is not determinable, it is treated as inter-state. What is the late fee if I file a nil return late?
For a nil GSTR-3B or nil GSTR-1 filed after the due date, the late fee is Rs.20 per day of delay (Rs.10 CGST plus Rs.10 SGST), capped at Rs.500 per return (Rs.250 plus Rs.250). No interest applies since there is no tax payable. While Rs.500 sounds small, defaults across several months add up, and the bigger cost is the compliance chain breaking and your GSTIN being flagged. Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Does compensation cess still apply on any goods?

What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST.
