The five per cent rate on electric vehicles has survived every subsequent restructuring.

The taxpayer filed GSTR-3B late and paid interest only on the net cash portion of the tax. The High Court held that on the language of Section 50 as it then stood, interest ran on the gross liability, because input tax credit is credited to the ledger only when the return is filed. The decision caused wide concern in trade, and Parliament later amended Section 50 with retrospective effect from 1 July 2017 to charge interest only on the cash component in most late-return cases.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. Retailers with seasonal return spikes benefit most from this facility.
My supplier issued a credit note against an earlier invoice. What must I do with the ITC?
When a supplier issues a credit note reducing the taxable value or tax, you must correspondingly reverse the proportionate ITC you had claimed on the original invoice, since the supplier's output liability reduces only when your credit reduces. The credit note flows into your GSTR-2B as a negative entry, and your GSTR-3B claim should net it off in the same period. With the Invoice Management System introduced on the portal from October 2024, you can accept, reject or keep pending supplier documents, and your action on a credit note directly shapes your GSTR-2B. Reconcile purchase returns, rate differences and discount credit notes monthly so reversals never lag behind.
Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Santhome trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent. What is the GST rate for salons, gyms and yoga centres?
From 22 September 2025, beauty and physical well-being services, covering salons, barbers, beauty parlours, gyms, fitness centres and yoga institutes, attract 5 percent GST without input tax credit, reduced from the earlier 18 percent. The condition attached to the concessional rate is important: because credit is barred, the GST paid on your rent, equipment, cosmetics and consumables becomes part of your cost base.
