Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.

What penalties does Section 122 of the CGST Act prescribe, and for which offences?

What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Beyond that, the demand becomes recoverable. Several traders in Shenoy Nagar have faced bank account attachment for ignored GSTR-3A notices, so act within the fifteen-day window.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?

I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
What happens if I do not reply to an ASMT-10 scrutiny notice?
If no satisfactory explanation is filed within thirty days, or you fail to correct the discrepancies, the officer can escalate the matter to a departmental audit under Section 65, a special audit under Section 66, an inspection under Section 67, or straightaway initiate a demand under Section 73 or Section 74. In practice, unanswered ASMT-10 notices convert into DRC-01A intimations and then show cause notices, where penalties and hearings enter the picture. Replying at the scrutiny stage is the cheapest point to close an issue, because you are only explaining, not yet defending a demand. Do not let the window lapse.
Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Verify the computation, pay only what is truly due, and contest the balance in Part B with reasons. ChennaiGST routinely trims DRC-01A figures for clients before payment.
I received an ASMT-10 scrutiny notice for my Shenoy Nagar business. What exactly is it?
ASMT-10 is a notice issued under Section 61 after the officer scrutinises your filed returns and finds discrepancies, such as differences between GSTR-1 and GSTR-3B, excess ITC compared with GSTR-2B, or turnover gaps against e-way bill data. It is not yet a demand; it is an opportunity to explain. For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered Shenoy Nagar manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu. Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Supermarkets and pharmacies with mixed inventories use this format daily, and billing software handles the split automatically once configured.
What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
Can I reduce GST for discounts given after the sale, like turnover incentives?
Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect.
