29th GST Council Meeting, New Delhi — 4 August 2018 (Signed Minutes, Agenda Item 3) · 2018-08-04

The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

Notification No. 1/2025-Central Tax (Rate), dated 16 January 2025 · 2025-01-16

Following the 55th GST Council meeting, fortified rice kernel classifiable under heading 1904 was placed at five per cent irrespective of end use, removing the earlier distinction based on whether it was supplied for public distribution. The same notification recast the definition of pre-packaged and labelled so that it clearly covers commodities intended for retail sale in packs of not more than twenty-five kilograms or twenty-five litres that must bear declarations under the Legal Metrology Act, 2009.

How are B2B and B2C invoices reported differently in GST returns?

B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. Both must match; mismatches between GSTR-1 and GSTR-3B are a common trigger for notices from the department, which is why we reconcile them before every filing.
Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. Classifying civil costs correctly during a project saves disputes at audit.
My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
What counts as exempt supply when calculating my ITC reversal ratio?
Exempt supplies for Rules 42 and 43 include nil-rated and wholly exempted supplies, and by virtue of Section 17(3) also cover outward supplies on which your recipient pays tax under reverse charge, transactions in securities valued at one percent of sale value, and sale of land or completed buildings valued at stamp duty value. Importantly, interest earned on deposits, loans or advances is excluded from the exempt turnover for this computation for everyone except banking companies and financial institutions. Many businesses in Surapet inflate their reversal by wrongly including fixed deposit interest, handing over credit the law never asked them to reverse.
My supplier filed GSTR-1 but never filed GSTR-3B. Does that affect my credit?
Yes, through Rule 37A. If your supplier reports the invoice in GSTR-1, the credit flows into your GSTR-2B and you may claim it, but if that supplier has not filed the GSTR-3B for the same period by 30 September following the end of the financial year, you must reverse the credit in a return filed on or before 30 November. Reversal done within this window carries no interest; delay beyond it attracts interest at 18 percent. The credit can be re-availed once the supplier eventually files GSTR-3B. A supplier filing-status check is therefore now part of any serious reconciliation for businesses in Surapet.
We are constructing our own office building in Surapet. Can we claim ITC on the materials and contractor bills?

What details must a GST tax invoice compulsorily contain?
Rule 46 of the CGST Rules prescribes the mandatory contents: your name, address and GSTIN; a consecutive serial number not exceeding sixteen characters, unique for the financial year; the date of issue; the recipient's name, address and GSTIN if registered; the HSN or SAC code; description, quantity and unit; total and taxable value; any discount; the rate and amount of CGST, SGST or IGST shown separately; place of supply with the state name for inter-state supplies; a declaration where tax is payable on reverse charge; and signature or digital signature of the supplier. Missing fields make the invoice defective and can jeopardise your buyer's credit.
Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Supermarkets and pharmacies with mixed inventories use this format daily, and billing software handles the split automatically once configured.
What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.

Enforcement has shifted from manual selection to data analytics. The portal now automatically compares GSTR-1 with GSTR-3B and flags tax shortfalls through DRC-01B intimations under Rule 88C, and compares GSTR-2B with GSTR-3B to flag excess ITC through DRC-01C under Rule 88D. E-way bill, e-invoice, TDS and income tax data are also cross-matched, and limitation deadlines for older financial years have pushed departments to clear pending demands in batches. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C. Eight digits are required for specified goods such as certain chemicals and for export documentation. Services follow the same rule using SAC codes, which begin with 99. Printing truncated or wrong codes on invoices creates mismatches later, so set the codes correctly in your billing software once.
Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge.
