WABCO India Ltd - AAR Tamil Nadu, Order No. TN/10/AAR/2018, dated 27 September 2018 · 2018-09-27

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

This notification removed the words governmental authority and government entity from the concessional works contract entries in the services rate notification. With effect from 1 January 2022, works contract services supplied to a governmental authority or a government entity ceased to enjoy the 12 per cent rate and moved to 18 per cent with input tax credit. Only supplies made directly to the Central Government, a State Government, a Union territory or a local authority continued at the concessional rate at that stage.

It extends the treatment from replacement of parts to replacement of goods or their parts, so that a full product replacement under warranty is covered on the same basis, with no GST and no credit reversal. It also addresses the position where a distributor replaces goods out of its own stock and is later replenished by the manufacturer, and the treatment of extended warranty sold separately after the original supply.

I received a debit note from a supplier for an old invoice. Which year's ITC deadline applies?
The deadline is counted from the date of the debit note, not the original invoice. After the Finance Act 2020 delinked debit notes from their underlying invoices, ITC on a debit note can be claimed up to 30 November following the end of the financial year in which the debit note itself was issued. So a debit note dated June 2025 against an invoice of January 2024 remains claimable until 30 November 2026. This delinking rescues many price-escalation and rate-difference credits that would otherwise appear time-barred, and it is worth checking before writing off any debit note credit as lost.
I make both taxable and exempt supplies. How is the Rule 42 credit reversal actually computed?
Rule 42 first removes credit exclusively for exempt supplies and non-business use, and credit exclusively for taxable supplies, leaving the common credit. From this common pool, you reverse the portion equal to exempt turnover divided by total turnover for the month, plus a flat five percent of the common credit where inputs are partly used for non-business purposes. The reversal is declared monthly in GSTR-3B, and a final recomputation for the whole year must be done, with any shortfall paid with interest, by the November return following the financial year.
