Entry 12, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28
As originally notified, Entry 12 exempted renting of a residential dwelling for use as residence, without any condition about who the tenant was. From 1 July 2017 to 17 July 2022 a house or flat let out for residential use carried no GST, whether the tenant was an individual, a firm or a company. The entry was narrowed with effect from 18 July 2022 so that the exemption no longer applies where the tenant is a registered person.
What it means for you: For rent periods up to 17 July 2022 a Chennai landlord had no GST liability on residential letting, which is a useful defence if an old notice questions those years.
Circular No. 127/46/2019-GST dated 4 December 2019 · 2019-12-04
Circular No. 107/26/2019-GST of 18 July 2019 had sought to classify certain information technology enabled services, and in particular back-office support supplied to overseas clients, in a way that could treat the Indian supplier as an intermediary and deny export status. After representations from the industry, CBIC withdrew that circular ab initio, so it is treated as never having been issued.
What to do about it: Chennai back-office and BPO units should ensure no notice relies on the withdrawn ITeS circular; the governing guidance is now Circular 159/15/2021 on intermediaries.
Paschimanchal Vidyut Vitran Nigam Ltd v. Raman Ispat (P) Ltd — Supreme Court, judgment dated 17-07-2023 · 2023-07-17
The Supreme Court distinguished its earlier Rainbow Papers ruling and held that in liquidation, government and statutory dues fall under Section 53(1)(e) of the Insolvency and Bankruptcy Code, ranking below secured creditors and workmen's dues. Rainbow Papers was confined to its own facts, where a resolution plan had been approved ignoring statutory dues. The waterfall mechanism laid down by Parliament must be respected and cannot be overridden by a general statutory charge.
Why this matters: For a Chennai business in liquidation, GST arrears will be paid only after secured lenders and workmen, which affects how recovery notices against the company should be handled.
