The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.
What to do about it: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.
Notification No. 7/2022-Central Tax (Rate), dated 13 July 2022 · 2022-07-13
This companion notification amended the exemption list so that the nil rate on cereals, pulses, flour and similar staples applies only where the goods are other than pre-packaged and labelled. Loose sale from an open sack or gunny bag remains exempt; the same commodity in a sealed retail pack bearing statutory declarations becomes taxable at five per cent. Both notifications came into force on 18 July 2022 and reshaped billing for every kirana and provision supplier.

Goods were detained because the e-way bill expired while the vehicle was stuck due to traffic blockades; the Telangana High Court quashed the Section 129 proceedings, holding there was no intention to evade tax and the officer could not have presumed evasion from mere expiry. The Supreme Court dismissed the department's SLP, enhanced costs payable to the taxpayer, and confirmed that tax evasion intent is essential before penalising technical e-way bill lapses.
What to do about it: If your consignment is detained for an expired e-way bill caused by genuine transit delays, contest the penalty — courts require proof of intent to evade, not just the lapse.
