A High Court may still entertain a writ petition where a fundamental right is enforced, where there is a violation of the principles of natural justice, where the order or proceeding is wholly without jurisdiction, or where the constitutional validity of a provision is challenged. The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.
What to do about it: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.

The Council recommended reducing the GST rate from 28 to 18 per cent on goods falling in 178 headings at the four-digit level, including four headings only partially pruned, so that the 28 per cent list fell from 224 tariff headings to only about 50. Further reductions were recommended from 28 to 12 per cent, from 18 to 12 per cent and from 18 to 5 per cent on specified goods, together with relief for the aviation and handicraft sectors and restaurants.
