The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Schedule IV at 1.5 per cent central tax, that is three per cent combined, covers pearls, silver, gold, platinum, base metals clad with precious metal, articles of jewellery, goldsmiths' and silversmiths' wares, imitation jewellery and coin. Schedule V at 0.125 per cent, that is 0.25 per cent combined, covers rough or simply sawn diamonds and unworked precious and semi-precious stones. Schedule VI at 0.75 per cent, that is 1.5 per cent combined, covers cut and polished diamonds and worked synthetic stones.

How long does a GST refund take after filing RFD-01?
The proper officer must issue the final refund order in RFD-06 within sixty days of receiving a complete application. For zero-rated supplies such as exports, a provisional refund of ninety percent of the claim is to be granted within seven days of the acknowledgement, subject to conditions. If the refund is delayed beyond sixty days, interest is payable to you on the refund amount. In practice, clean documentation and prompt replies to any query in RFD-08 decide the actual speed.
