Food delivery apps made liable to pay GST on restaurant supplies

Notification No. 17/2021-Central Tax (Rate) dated 18.11.2021 · 2021-11-18

With effect from 1 January 2022, restaurant service supplied through an electronic commerce operator was notified under section 9(5) of the CGST Act. The operator, such as a food delivery platform, became liable to collect and pay the tax on those supplies instead of the restaurant, except where the restaurant is located in specified premises. The same notification also brought passenger transport by omnibus and certain motor vehicles supplied through an operator within section 9(5). Restaurants continue to report such supplies but do not pay tax on them.

What to do about it: A Chennai restaurant selling through a delivery app should show those sales separately in GSTR-3B as supplies on which the operator pays tax, and must not pay tax on them again.

Bharat Sanchar Nigam Ltd v. Union of India — Supreme Court, (2006) 3 SCC 1, judgment dated 02-03-2006 · 2006-03-02

The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. Is GST still charged on health insurance premiums?
Not on individual policies. With effect from 22 September 2025, premiums on all individual life insurance policies and individual health insurance policies, including family floater and senior citizen plans, are exempt from GST, along with their reinsurance. Earlier these attracted 18 percent, so the change directly reduces the premium outgo for households. Group policies taken by businesses for employees continue to be taxable, and the input tax credit position on such group covers still depends on whether the cover is statutorily obligatory.
