The applicant generated FORM GST RFD-01A online, printed it and submitted it with supporting documents to the jurisdictional office, which issued acknowledgement in RFD-02, a deficiency memo where needed in RFD-03, the provisional refund order in RFD-04 and the final sanction or rejection order in RFD-06. It also set out the documents and statements required for exports of goods and of services.

Exercising its powers under Article 142, the Supreme Court directed that the period from 15 March 2020 to 28 February 2022 shall stand excluded in computing limitation for any suit, appeal, application or proceeding, whether under general law or any special law. Where the balance limitation remaining was less than ninety days, a fresh period of ninety days from 1 March 2022 was granted. Statutory authorities were bound by this direction.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.
