Tobacco products had been left at twenty-eight per cent in Schedule VII when GST 2.0 took effect, pending discharge of the compensation cess loan obligations. This notification omits Schedule VII entirely with effect from 1 February 2026 and moves pan masala, unmanufactured tobacco and refuse, cigars and cigarettes, other manufactured tobacco and nicotine inhalation products into Schedule III at forty per cent. Biris of tariff items 2403 19 21 and 2403 19 29 were placed in Schedule II at eighteen per cent.

In proceedings arising from a mismatch between returns, the assessing officer confirmed the demand without meaningfully dealing with the taxpayer's explanation and supporting material. The Madras High Court set aside the order, reiterating that adjudication under the GST Acts requires application of mind to the reply and documents filed in response to the show cause notice, and remanded the matter for fresh consideration after affording the taxpayer a reasonable opportunity of hearing.
What to do about it: If your DRC-01 reply was ignored and the demand confirmed mechanically, a writ challenge for breach of natural justice can win a remand — preserve proof of your reply and hearing requests.

Where an appellate authority, tribunal or court holds that a notice issued under Section 74 is not sustainable because fraud, wilful misstatement or suppression of facts is not established, Section 75(2) requires the proper officer to re-determine the tax as though the notice had been issued under Section 73. The Board clarified that this re-determination must be completed within two years from the date of communication of that order, and only the normal period demand can survive.
Why this matters: Winning on the suppression point in appeal does not end the matter, but it limits the surviving Chennai demand to the normal period and starts a two-year clock on the department.
