Schedule III carries twenty per cent central tax, that is forty per cent combined, and is deliberately short. It covers aerated waters and other beverages containing added sugar or sweetening matter, caffeinated beverages, carbonated beverages of fruit drink, larger motor cars and hybrids above the small-car limits, motorcycles above 350 cc, aircraft for personal use, yachts and pleasure vessels, revolvers and pistols, smoking pipes and cigarette holders, and specified actionable claims such as betting, casinos, lottery and online money gaming.
What to do about it: Only a narrow list attracts forty per cent, so a supplier pushed into that slab by an officer should check whether the goods actually appear in Schedule III.
Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04
The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.
What to do about it: Chennai hostel and paying guest operators should not assume exemption; the outcome turns on the exact facts and on later High Court rulings.
Nagri Eye Research Foundation v. Union of India — Gujarat High Court, Special Civil Application No. 7822 of 2021, judgment dated 9 July 2021 · 2021-07-09
A charitable trust ran a medical store attached to its hospital, selling medicines at a discount, and argued that as it worked without profit motive it was not carrying on business and needed no registration. The High Court held that the sale of medicines is a supply of goods, and that the absence of a profit motive does not take the activity outside the definition of business under the CGST Act. The trust was therefore required to obtain registration once the threshold was crossed.
Practical effect: Trusts, societies and associations in Chennai cannot assume that having no profit motive means no GST — registration turns on the supply, not the motive.
