These directions led to CBIC Instruction No. 01/2022-23 (GST-Investigation) deprecating coercive collection during searches.

CBIC explained the implementation of the retrospective ITC relaxations: for FY 2017-18 to 2020-21, credit claimed in GSTR-3B filed up to 30 November 2021 is valid, and taxpayers with confirmed demands on this sole ground must use the special rectification procedure rather than appeals where the order was not contested. It also clarified, following Section 150 of the Finance (No. 2) Act, 2024, that no refund arises for tax already paid or credit already reversed on this issue.
