The Supreme Court held that interest on a delayed refund becomes payable from the date immediately after the expiry of three months from the date of receipt of the refund application, and not from the date on which the refund is finally sanctioned or an appellate order is passed. The statutory obligation to pay interest is automatic once the period lapses, irrespective of the reason for departmental delay.
Practical effect: A Chennai exporter whose GST refund is delayed beyond sixty days should claim statutory interest computed from the end of that period, not from the sanction date.
Toshniwal Brothers (SR) Pvt Ltd — AAR Karnataka, Advance Ruling No. KAR ADRG 23/2018, dated 19 September 2018 · 2018-09-19
The applicant promoted the products of overseas manufacturers in India and also carried out installation, commissioning and after-sales support for Indian customers, billing the foreign principal in convertible foreign exchange. The Karnataka Authority for Advance Ruling held that this activity facilitates the supply between the foreign principal and the Indian customer, making the applicant an intermediary. The place of supply is therefore in India and the receipts do not qualify as export of service.
What to do about it: Chennai firms invoicing foreign principals for marketing or support work should test the intermediary risk before treating the receipts as zero-rated exports.
Circular No. 37/11/2018-GST dated 15 March 2018 · 2018-03-15
This circular resolved several export refund disputes. An exporter claiming drawback only of basic customs duty remains eligible for refund of unutilised input tax credit. Where exports had already been made before the Letter of Undertaking was furnished, the delay in furnishing the LUT could be condoned and export under LUT allowed on an ex post facto basis, because the substantive benefit of zero rating cannot be denied once the exports are established. A refund claim must relate to a tax period, and once a deficiency memo is issued a fresh application has to be filed. It also clarified the treatment of credit availed in an earlier period. It was later rescinded by Circular No. 125/44/2019-GST.
Why this matters: The drawback and deficiency-memo positions taken here shaped later refund practice, but current claims must follow the master refund Circular 125/44/2019.
