Where a single investigation covers several taxpayers spread across different States, one officer now adjudicates the whole case instead of each jurisdiction passing its own order. The change is meant to avoid conflicting decisions and multiple parallel proceedings on the same set of facts.

Five bank accounts were provisionally attached under Section 83 by an order that simply recited that attachment was necessary 'in order to protect the interest of the Revenue'. The Court set the attachment aside, holding that the power under Section 83 is draconian and can be exercised only on a formation of opinion based on tangible material, recorded in a reasoned order. A single-line justification does not meet that standard. Liberty was given to the department to re-attach on proper material.
Practical effect: If a Chennai firm's bank account is frozen under Section 83, obtain a copy of the attachment order at once — an order with no recorded reasons or tangible material is liable to be quashed.

The minimum threshold of tax for launching prosecution under Section 132 was raised from Rs 1 crore to Rs 2 crore, except for the offence of issuing invoices without any supply. The compounding amount was reduced from the range of 50 to 150 per cent of tax to 25 to 100 per cent. Three offences were decriminalised altogether: obstructing or preventing an officer in the discharge of duties, deliberate tampering with material evidence, and failure to supply information.
Why this matters: Ordinary compliance failures below Rs 2 crore of tax no longer expose a Chennai proprietor to criminal prosecution, though fake invoicing remains prosecutable at any value.
