The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

No GST on reimbursing a foreign parent for shares issued to Indian employees

Circular No. 213/7/2024-GST · 2024-06-26

Where a foreign holding company allots its own shares to employees of its Indian subsidiary under an ESOP, ESPP or RSU plan and the Indian subsidiary reimburses the cost on a cost-to-cost basis, CBIC clarified that the transaction is in securities and is not a supply of goods or services. No GST is therefore payable by the Indian company under reverse charge on that reimbursement. GST applies only if the foreign company charges an additional amount such as a markup or administration fee.

Courts take cognizance only with the Commissioner's previous sanction.
I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. How do I get a provisional attachment on my property or bank account lifted quickly?

Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Thoraipakkam buying stationery from an unregistered shop has no Section 9(4) liability at all.

Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
