The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.

This notification designated www.gst.gov.in, managed by the Goods and Services Tax Network, as the Common Goods and Services Tax Electronic Portal for registration, payment of tax, and furnishing of returns. Following the 50th GST Council meeting, CBIC clarified that supply of food and beverages at the snack counters of a cinema hall is taxable as restaurant service at 5 per cent without input tax credit, provided it is supplied independently of the cinema exhibition service. Where a ticket and food are clubbed into a single package, the transaction is a composite supply with exhibition as the principal supply and the ticket rate applies to the whole amount.
Practical effect: Chennai multiplex operators should keep counter sales separately invoiced from tickets, otherwise the entire combo value gets taxed at the higher exhibition rate.
