A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
How we apply it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.
Practical effect: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

Three clarifications were given. From 1 January 2021 the date of the debit note, and not the date of the underlying invoice, determines the financial year for the time limit in section 16(4), so credit on an old invoice can still be taken through a later debit note. Where an invoice carries an Invoice Reference Number under the e-invoicing system, the transporter need not carry a physical copy. The bar on refund of unutilised credit applies only to goods actually subjected to export duty.
Practical effect: This restored credit on debit notes for earlier years and removed the need to carry paper invoices once e-invoicing is in place.
