This notification brought into force Section 112 of the Finance Act, 2021, which substituted the proviso to Section 50(1) of the CGST Act with retrospective effect from 1 July 2017. The result is that interest on late payment of tax through a delayed GSTR-3B is chargeable only on the portion discharged in cash, for all periods from the inception of GST, and not merely from September 2020. This ended the large body of litigation over gross-liability interest demands.
Why this matters: Every interest demand computed on gross liability for any period since July 2017 is unsustainable, and this is one of the most useful notifications to cite in a Chennai interest dispute.

A five-judge Bench overruled the earlier view and held that a composite contract for manufacture, supply and installation of a lift is a works contract, because the lift comes into existence as a functional unit only on installation at site. The dominant nature test was rejected for contracts falling within the deemed sale of works contracts. The composite character of such contracts is now the basis of works contract taxation under GST.
What it means for you: Chennai contractors doing supply-plus-installation work should classify the transaction as a works contract service under GST rather than splitting it into goods and labour.

Summing up a long debate over five-band and six-band options, the Chairperson proposed and the Council accepted a structure with one exempt category covering food grains and similar essentials, a lower rate of five per cent for goods consumed by vulnerable sections, standard rates of 12 and 18 per cent, and a higher slab of 28 per cent. A committee of officers was directed to fit individual goods and services into those slabs. Proposals for a 40 per cent slab were rejected.
