CBIC v. Aberdare Technologies (P) Ltd — Supreme Court, 2025 (SLP against Bombay HC order dated 29-07-2024 dismissed) · 2025-03-21
The Bombay High Court permitted Aberdare Technologies to correct bona fide clerical errors in its GST returns beyond the statutory deadline where there was no loss of revenue. Dismissing the department's SLP, the Supreme Court observed that human errors are normal, denying correction unjustifiably burdens taxpayers and benefits the department at their cost, and asked CBIC to re-examine the rigid timelines for rectifying returns since software limitations cannot defeat substantive rights.
What to do about it: If a genuine clerical mistake in GSTR-1 or GSTR-3B is blocking your customer's ITC or inflating your liability, courts now support rectification even beyond the deadline where revenue is not prejudiced.
45th GST Council Meeting, Lucknow — 17 September 2021 · 2021-09-17
The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.
Why this matters: Tamil Nadu's textile and footwear clusters faced a five to twelve per cent increase from January 2022, a decision the Council reversed for textiles on 31 December 2021, the eve of implementation.
GSTN Advisory dated 14 November 2023 — input tax credit reversal under Rule 37A of the CGST Rules for FY 2022-23 · 2023-11-14
Rule 37A requires a buyer to reverse input tax credit where the supplier reported the invoice in GSTR-1 but did not file the GSTR-3B for that tax period by 30 September following the end of the financial year. The reversal must be made in the GSTR-3B filed on or before 30 November. GSTN made supplier-wise details of such invoices available on the portal and advised taxpayers to complete the reversal for FY 2022-23 by 30 November 2023. The credit can be reclaimed once the supplier files the pending return.
What to do about it: Run a supplier compliance check every October, because credit from a defaulting supplier must be reversed by 30 November or carries interest.
