Rich Dairy Products (India) Pvt Ltd - AAR Tamil Nadu (2019), upheld by AAAR Tamil Nadu, Order No. TN/AAAR/01/2020 · 2019

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Circular No. 99/18/2019-GST dated 23 April 2019 · 2019-04-23

Following Removal of Difficulty Order No. 05/2019-Central Tax, CBIC clarified that a person whose registration was cancelled on or before 31 March 2019 for non-filing of returns could apply for revocation up to 22 July 2019. Where cancellation took effect from the order date, all returns up to that date had to be filed first. Where it was cancelled retrospectively, returns for the whole period from the effective date of cancellation had to be furnished within thirty days of the revocation order.

Mr. Kannippan Arumugan v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 2943 of 2026, decided 30 January 2026 (C. Saravanan J.) · 2026-01-30

The taxpayer had reported tax of Rs 2,54,040.30 against an invoice instead of the correct Rs 1,31,280.30, and a demand followed. The Court quashed the assessment order dated 21 July 2025 and remitted the matter for fresh adjudication within six months, permitting the petitioner to rectify the inadvertent error subject to compliance with Circular No. 212/6/2024-GST, and directing the officer to verify with the recipient's jurisdiction whether excess credit had in fact been availed.

Why this matters: A clerical overstatement in GSTR-1 by a Chennai supplier can still be corrected long afterwards, provided the recipient has not taken the excess credit and the Circular 212 procedure is followed.

What happens if I miss filing GSTR-3B this month?
A late fee of Rs.50 per day (Rs.20 per day for a nil return) accrues automatically, capped based on your turnover, and interest at 18 percent per annum applies on tax paid late. You also cannot file the next period's GSTR-1 until the pending GSTR-3B is filed, since returns must be filed sequentially. If two consecutive tax periods remain unfiled, e-way bill generation gets blocked, and continued default can lead to suspension of your GSTIN. Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. How do I pay tax monthly under QRMP if the return is only quarterly?
For the first two months of each quarter, tax is deposited through challan PMT-06 by the 25th of the following month. Is a pure labour contract for building a house exempt from GST?
