Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04

The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

Old GST returns are being archived and removed from the portal

GSTN Advisory dated 24 September 2024 — archival of GST returns data older than seven years · 2024-09-24

GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. Taxpayers were advised to download and preserve their returns and supporting data before the archival date for each period.

Circular No. 184/16/2022-GST · 2022-12-27

Where an Indian transporter supplies goods transport services to a registered Indian recipient but the destination of the goods is outside India, the proviso to Section 12(8) of the IGST Act fixed the place of supply outside India. The Board clarified that this remains an inter-State supply on which integrated tax is payable, that the supplier must report it correctly in GSTR-1, and that the Indian recipient is entitled to input tax credit. The proviso itself was later omitted with effect from 1 October 2023.

A client paid me an advance. Do I raise an invoice or something else?
On receiving an advance, you issue a receipt voucher under Rule 50, not an invoice; the tax invoice follows when the service is actually supplied. GST is payable on advances received for services in the period of receipt, and the receipt voucher documents that liability. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. If the rate is not determinable when the advance arrives, tax is paid at 18 percent, and if the nature of supply is not determinable, it is treated as inter-state. How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
What is a debit note under GST and when do I issue one?
You issue a debit note when the taxable value or tax charged in the original invoice was less than what is actually payable, for example a price escalation clause kicking in or a rate charged short. Declaring the debit note in GSTR-1 increases your output liability, payable with interest where the shortfall relates to an earlier period. There is no outer time limit on issuing a debit note itself. For your buyer, the debit note is a credit document: following the amendment to Section 16(4), the buyer's time limit to claim ITC runs from the date of the debit note, not the original invoice.
I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
What is the difference between GSTR-2A and GSTR-2B, and which one should I follow?
GSTR-2A is a dynamic statement that keeps changing as suppliers file or amend their returns, so the same month's data can look different on different dates. GSTR-2B is a static statement generated on the 14th of each month, capturing supplier filings between cut-off dates, and it never changes afterwards. The law ties your ITC eligibility to GSTR-2B, and GSTR-3B auto-populates from it, so 2B is the statement to reconcile against for monthly claims. GSTR-2A remains useful for tracing when an invoice was actually uploaded, which helps in replying to departmental queries about earlier periods.
How do I pay tax monthly under QRMP if the return is only quarterly?
For the first two months of each quarter, tax is deposited through challan PMT-06 by the 25th of the following month. You can use the fixed sum method, paying 35 percent of the tax paid in cash in the previous quarter (or 100 percent of the tax paid in cash in the last month of the previous quarter if you were a monthly filer), or the self-assessment method, paying actual liability after adjusting input tax credit. What are the current GST rate slabs after the GST 2.0 changes?

The cost is that input tax credit on those goods must be reversed. Two traps deserve care: gifts to related persons or between distinct GSTINs of the same PAN are taxable under Schedule I even without consideration, and promotional schemes like buy one get one are treated as a single price for two items, taxed normally with credit intact. What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Can I reduce GST for discounts given after the sale, like turnover incentives?
