The taxpayer argued that because credit was sitting in its electronic credit ledger, no interest should arise on delayed returns. The Madras High Court largely rejected this, confirming an interest demand of about Rs. 1.19 crore and holding that credit is set off against output tax only when it is actually debited at the time the return is filed. Availability of a credit balance, without an accompanying return, does not amount to discharge of tax.

What it means for you: Sitting on an unused credit balance is no defence to interest — the return must actually be filed and the credit debited for the liability to be treated as discharged.

Notification No. 63/2020-Central Tax · 2020-08-25

This notification brought into force, with effect from 1 September 2020, the amendment to Section 50 of the CGST Act made by the Finance (No. 2) Act, 2019. The amendment provides that where a return is filed late, interest is charged only on that portion of the tax liability which is discharged in cash through the electronic cash ledger, and not on the part settled from input tax credit. Because it was made effective only prospectively, it caused considerable litigation over earlier periods.

What is the due date for GSTR-3B in Tamil Nadu?
For monthly filers, GSTR-3B is due on the 20th of the following month. If you are registered in Tamil Nadu and have opted for the QRMP scheme, your quarterly GSTR-3B is due on the 22nd of the month following the quarter. GSTR-3B is the summary return through which you actually pay tax, so missing it attracts a late fee of Rs.50 per day (Rs.20 for nil returns) plus interest at 18 percent per annum on tax paid late.
A client paid me an advance. Do I raise an invoice or something else?
On receiving an advance, you issue a receipt voucher under Rule 50, not an invoice; the tax invoice follows when the service is actually supplied. GST is payable on advances received for services in the period of receipt, and the receipt voucher documents that liability. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. If the rate is not determinable when the advance arrives, tax is paid at 18 percent, and if the nature of supply is not determinable, it is treated as inter-state. When can I issue a GST credit note against my sales invoice?

SMS filing works only if the return is genuinely nil, meaning no outward supplies, no liability of any kind, and no pending returns for earlier periods. If the SMS route fails, we can file it online for you the same day.
My supplier has not uploaded an invoice and it is missing from GSTR-2B. Can I still claim the ITC?
No, not until it appears. Since 1 January 2022, Section 16(2)(aa) permits ITC only on invoices furnished by the supplier in GSTR-1 and communicated to you in GSTR-2B; the earlier provisional credit tolerance is gone. Claiming credit on a missing invoice invites a Rule 88D intimation and reversal with interest at 18 percent. The practical remedy is vendor follow-up: withhold the tax portion of payment until the supplier uploads, and claim the credit in the month it appears in GSTR-2B, subject to the overall time limit of 30 November following the financial year. Vendor discipline clauses in purchase orders help enormously.
Can nil GSTR-1 also be filed through SMS?
Yes. Send NIL space R1 space your GSTIN space tax period in MMYYYY format (use the quarter-ending month for quarterly filers) to 14409 from the registered mobile number of the authorised signatory. Confirm with the CNF code received, and the portal issues an ARN. A nil GSTR-1 is possible only when there are no outward supplies at all, including no credit notes, amendments or documents to report for that period. What details must a GST tax invoice compulsorily contain?

Repeated delays lead buyers to withhold the GST portion of payments or move to more compliant vendors. Timely GSTR-1 filing is therefore a commercial necessity, not just a legal one. No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
