Notification No. 1/2017-Central Tax (Rate), dated 28 June 2017 (G.S.R. 673(E)) · 2017-06-28
This was the founding rate notification for goods. It listed every taxable item against its Customs Tariff heading in six schedules, prescribing central tax of 2.5, 6, 9, 14, 1.5 and 0.125 per cent, which with the matching State tax gave the familiar 5, 12, 18, 28, 3 and 0.25 per cent rates. Anything not listed in a schedule or exempted separately fell to the residual 18 per cent rate. It was amended dozens of times before being superseded on 22 September 2025.
How we apply it: For any dispute about a supply made up to 21 September 2025, the rate must be traced to the schedule entry of this notification as it stood on the date of supply, not to today's rate.

Summing up a long debate over five-band and six-band options, the Chairperson proposed and the Council accepted a structure with one exempt category covering food grains and similar essentials, a lower rate of five per cent for goods consumed by vulnerable sections, standard rates of 12 and 18 per cent, and a higher slab of 28 per cent. A committee of officers was directed to fit individual goods and services into those slabs. Proposals for a 40 per cent slab were rejected.
Why this matters: Every rate dispute a Chennai business faces today traces back to this four-slab architecture and to the fitment exercise it launched.
Munjaal Manishbhai Bhatt v. Union of India — Gujarat High Court, 2022 · 2022-05-06
In a bungalow purchase where land constituted the dominant value, the Gujarat High Court held that the deeming fiction treating land value as one-third of the total consideration for GST on construction is arbitrary if applied mandatorily. Where the actual value of land is ascertainable from the agreement, tax must be computed after deducting the real land value; the one-third deduction in the rate notification was read down as optional, available at the taxpayer's choice.
What to do about it: Builders and buyers with separately valued land agreements can compute GST on actual construction value — worth revisiting for plotted developments and villa projects around Chennai.
