The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.

CBIC explained the scope of the principal-agent relationship in Schedule I. The deciding test is the invoice: where the agent issues the invoice for the supply of goods in his own name, or receives goods in his own name from the supplier on behalf of the principal, the transaction between principal and agent is a deemed supply even without consideration. Acting on the 45th GST Council recommendation, the Government raised the rate on solar power based devices, solar generators, photovoltaic cells and modules, wind operated electricity generators, biogas plants and waste-to-energy devices from five per cent to twelve per cent with effect from 1 October 2021. Combined with the 70:30 deeming rule, this pushed up the delivered cost of rooftop and utility scale solar projects and prompted a wave of contract repricing and change-of-rate disputes under Section 14.
What to do about it: Projects straddling 1 October 2021 must fix the rate using the time-of-supply rules in Section 14, since invoice date, payment date and supply date can point to different rates.
