The Council waived late fee for taxpayers who furnished all pending statements of outward supplies in GSTR-1 for the tax periods from July 2017 to November 2019, provided they were filed by 10 January 2020. It also decided that e-way bill generation would be blocked for taxpayers who had not filed GSTR-1 for two tax periods, extending the blocking mechanism that already applied to GSTR-3B defaulters. Standard operating procedures were prescribed for officers dealing with non-filers, and Grievance Redressal Committees were set up at zonal and state level.
How we apply it: GSTR-1 default now carries its own e-way bill block, so filing GSTR-3B alone is not enough to keep despatches moving.

The taxpayer argued that because credit was sitting in its electronic credit ledger, no interest should arise on delayed returns. The Madras High Court largely rejected this, confirming an interest demand of about Rs. 1.19 crore and holding that credit is set off against output tax only when it is actually debited at the time the return is filed. Availability of a credit balance, without an accompanying return, does not amount to discharge of tax.
What to do about it: Sitting on an unused credit balance is no defence to interest — the return must actually be filed and the credit debited for the liability to be treated as discharged.

CBIC explained the effect of the Supreme Court's order of 27 April 2021 extending limitation. The extension applies where an appeal has to be filed against a quasi-judicial order before the Joint or Additional Commissioner (Appeals), the Commissioner (Appeals), the Appellate Authority for Advance Ruling, the Tribunal or the courts, or where a revision or rectification of an order has to be sought. It does not apply to proceedings a taxpayer has to initiate or compliances he has to make, which remain governed only by the statute and by the notifications issued under section 168A of the CGST Act, nor to the quasi-judicial work of officers such as deciding refund claims, revocation applications and demand adjudications, which may continue.
How we apply it: A Chennai taxpayer who missed an appeal deadline during the pandemic waves can rely on this relief, but return filing dates were never covered by it.
