37th GST Council Meeting, Goa — 20 September 2019 · 2019-09-20

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

What it means for you: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

No second levy of IGST when goods leave a Free Trade Warehousing Zone

The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Practical effect: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.

ITC and credit note deadline moved to 30 November of the next year

Notification No. 18/2022-Central Tax · 2022-09-28

This notification brought most of the Finance Act, 2022 amendments into force from 1 October 2022. Section 16(4) was amended so that input tax credit for a financial year can be claimed up to 30 November of the following year instead of the due date of the September return. The same deadline now applies to issuing credit notes under Section 34 and to rectifying errors in GSTR-1 and GSTR-3B. Section 41 was also substituted to remove provisional credit and sequential filing of returns was mandated.

Practical effect: A Chennai business gets until 30 November to pick up missed credit and to issue credit notes for the previous year, which is the single most important annual deadline after the returns themselves.

Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. For current periods, GST on CSR purchases, whether school furniture donated or medical supplies distributed, is a cost. Hotel accommodation is taxed where the hotel is located, so a Mumbai hotel charges CGST plus Maharashtra SGST even when the guest's employer is registered in Tamil Nadu. Your Tamil Nadu GSTIN can utilise only IGST, CGST and Tamil Nadu SGST, so another state's CGST and SGST is unusable credit; it will appear in your GSTR-2B but must be excluded from the claim. Options are limited: absorb it as cost, or obtain registration in states with heavy recurring stays, which rarely pays.
