Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
Practical effect: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.

A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.
What to do about it: Chennai apartment associations should apply the High Court position carefully and keep member-wise workings ready for departmental scrutiny.
Notification No. 12/2018-Central Tax dated 07.03.2018 · 2018-03-07
After the failed first attempt at rollout, this notification substituted rules 138, 138A, 138B, 138C and 138D of the CGST Rules with a redrafted set. The revised rules refined who must generate the e-way bill, introduced clearer treatment of transport by rail, air and vessel, addressed transfer of goods between conveyances and consolidated e-way bills, and rationalised the validity period and the list of exempt movements.
Practical effect: The e-way bill rules a Chennai business follows today are substantially the version substituted by this notification, so older commentary written before March 2018 can be misleading.
