CBIC clarified that serving food in schools under the mid-day meal programme is exempt from GST, and that the exemption extends to pre-schools and anganwadis, which are covered within the meaning of an educational institution providing pre-school education. It further clarified that the exemption applies whether the meals are funded by government grants or by corporate donations, since the entry does not distinguish by source of funding. The clarification protected non-profit caterers running school feeding programmes from demands.
Why this matters: Chennai caterers running school or anganwadi meal contracts are exempt, but should keep the scheme documentation on file to answer any scrutiny.

Following widespread demands computing interest on the gross tax liability of a late GSTR-3B, ignoring the credit balance available, the Council recommended that interest under Section 50 be charged only on the net cash tax liability, with retrospective effect from 1 July 2017. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.
Why this matters: If you have received an interest demand computed on gross output tax for a late return, the net cash liability principle from this meeting is usually a complete answer.

The department issued recovery notices for interest under Section 50 without any adjudication, treating the interest as automatically payable. The High Court held that although interest liability under Section 50 is automatic in principle, its computation and quantum are not. Where the taxpayer disputes the liability, the department must first initiate adjudication proceedings under Section 73 or 74 and pass an order before resorting to recovery under Section 79.
What to do about it: A bare recovery letter for interest, without a show cause notice and order, can be challenged if you genuinely dispute the amount.
