The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.

It confirmed that electrically operated vehicles attract the five per cent rate whether or not they are fitted with a battery pack at the time of supply, and that treated sewage water is exempt because the exclusion for purified water does not extend to it. Rates on fly ash bricks and blocks and on certain by-products of milling of pulses were also clarified.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
My bank account was debited for a GST challan but the cash ledger shows nothing. What do I do?
This is a payment-communication failure between the bank and the portal, and the prescribed remedy is Form PMT-07, filed under Services, then Payments, then Grievance against Payment. Quote the CPIN, bank name and debit details; the system takes up the discrepancy with the bank, and the amount either credits your ledger once the bank confirms, or is re-credited to your account if the transaction failed. Do not pay twice immediately; most cases resolve within a day or two. If a return due date is pressing, generate a fresh challan and later seek refund of the duplicate. Can I issue a single credit note against several invoices?
Yes. Since the amendment to Section 34 by the CGST (Amendment) Act, 2018, effective 1 February 2019, the law permits one or more credit notes to be issued against one or more tax invoices of a financial year. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. Such invoices must be reported individually in Table 5 of GSTR-1 with the place of supply, instead of being merged into the consolidated B2C summary. The rule helps states track high-value consumer sales flowing across borders. No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Note that if you used the fixed sum method and paid the pre-filled 35 percent amount on time, no interest applies for the first two months even if actual liability was higher, provided the balance is paid in the quarterly GSTR-3B by its due date. Late fee does apply if the quarterly GSTR-1 or GSTR-3B itself is filed late.
What information is needed to prepare my GSTR-9?
The portal auto-drafts GSTR-9 from your filed GSTR-1 and GSTR-3B, and provides a system-computed summary along with GSTR-2A/2B data for credit tables. To verify and complete it we need your audited or finalised financial statements, sales and purchase registers, input tax credit ledger, details of RCM payments, HSN-wise summaries, and any DRC-03 payments made during the year. I claimed some ITC wrongly last year. What interest and penalty apply if I reverse it now?
Under Section 50(3) as amended, interest at 18 percent per annum applies where wrongly availed credit has also been utilised, calculated from the date of utilisation until reversal; credit that was availed but never utilised, because your ledger balance never fell below the wrong amount, attracts no interest. Voluntary reversal is done through GSTR-3B or by payment in DRC-03, and paying before any show cause notice generally avoids or minimises penalty. I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
My GST status shows suspended. What does that mean for my business in Virugambakkam?
