Officers searched a godown storing PVC pipes and issued detention and penalty orders under Section 129(3), recording fictitious vehicle numbers such as 'UPGODOWN02' in the forms. The High Court quashed the orders, holding that Section 129 applies to goods in transit and cannot be invoked against goods stored at immovable premises. The proceedings were held to be without jurisdiction, and the Commissioner was directed to examine the conduct of the officers concerned.

As originally notified, Entry 12 exempted renting of a residential dwelling for use as residence, without any condition about who the tenant was. From 1 July 2017 to 17 July 2022 a house or flat let out for residential use carried no GST, whether the tenant was an individual, a firm or a company. The entry was narrowed with effect from 18 July 2022 so that the exemption no longer applies where the tenant is a registered person.

Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax.
