The club collected membership subscriptions and admission fees which were spent on meetings, administration and communication, with no facility or benefit supplied to members in return. The Maharashtra Appellate Authority for Advance Ruling held that the collections merely defray shared expenses, that there is no supply of goods or services to members, and that the amounts are therefore not consideration liable to tax.
Why this matters: Chennai associations should note that Section 7(1)(aa), inserted with retrospective effect from 1 July 2017, now treats club to member supplies as taxable, so this reasoning no longer holds.

As a Covid relief measure, the rule 36(4) credit restriction was not applied separately for each of the tax periods February to August 2020. CBIC clarified that the taxpayer must instead apply the restriction cumulatively for those seven months while filing the GSTR-3B for September 2020, comparing the aggregate credit taken with the aggregate credit reflected in GSTR-2A for that whole span, and reversing any excess in that return.
What it means for you: Any scrutiny of credit for the first Covid year must be tested cumulatively for February to August 2020, not month by month.

The statement of self-assessed tax in Form GST CMP-08 for the quarter ending 31 March 2020 was allowed to be furnished up to 7 July 2020 instead of 18 April 2020. The annual return in Form GSTR-4 for the financial year 2019-20 was allowed up to 15 July 2020 instead of 30 April 2020. This was the first COVID concession specifically for composition taxpayers, who had otherwise been left out of the relief given to regular filers.
What to do about it: Chennai composition dealers such as small traders and eateries had a three-month reprieve for the 2019-20 filings, which should be cited against any late-fee entry for that year.
