The Supreme Court held that where a special taxing statute provides a complete code with its own limitation scheme, the general provisions of the Limitation Act permitting condonation of delay do not apply. Delay in filing a reference or appeal beyond the period prescribed by the special statute cannot be condoned. The scheme, language and object of the special Act determine whether the Limitation Act is impliedly excluded.

CBIC notified a special procedure under Section 148 for manufacturers of pan masala, unmanufactured tobacco, chewing tobacco, zarda and similar products. Such manufacturers must declare details of every packing machine, its make, capacity and installation address, in Form GST SRM-I within the prescribed time, report any addition or removal of machines, and file a monthly statement of inputs and outputs in Form GST SRM-II. The procedure took effect from 1 April 2024 and carries a separate penalty for unregistered machines.

Practical effect: Any Chennai unit packing tobacco or pan masala products must register every machine in SRM-I and file SRM-II monthly, entirely separate from its normal GST returns.

The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. Can my GST consultant attend a summons hearing on my behalf in Adambakkam?

I agree with part of the ASMT-10 discrepancy but not all of it. How do I respond?
A split response is perfectly acceptable and often the wisest course. Pay the portion you accept through Form DRC-03 with interest at 18 percent per annum, and in your ASMT-11 reply state the payment details along with a reasoned explanation for the balance, supported by reconciliations, invoices and ledger extracts. Paying the admitted amount voluntarily at the scrutiny stage avoids penalty on it under Section 73 and shows bona fides, which helps the officer accept your explanation on the disputed part. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
My customer in Mumbai asked me to deliver goods directly to his buyer in Adambakkam. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point. So you invoice the Mumbai customer with IGST even though the goods physically moved within Tamil Nadu, and the Mumbai customer raises a second invoice on the ultimate recipient in Adambakkam.
