Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

This notification exempts from obtaining registration those persons who supply only goods or services on which the entire tax is payable by the recipient under reverse charge in terms of section 9(3) of the CGST Act. Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected.
