The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.

Net cash interest rule given retrospective effect from July 2017

Notification No. 16/2021-Central Tax · 2021-06-01

This notification brought into force Section 112 of the Finance Act, 2021, which substituted the proviso to Section 50(1) of the CGST Act with retrospective effect from 1 July 2017. The result is that interest on late payment of tax through a delayed GSTR-3B is chargeable only on the portion discharged in cash, for all periods from the inception of GST, and not merely from September 2020. This ended the large body of litigation over gross-liability interest demands.

Why this matters: Every interest demand computed on gross liability for any period since July 2017 is unsustainable, and this is one of the most useful notifications to cite in a Chennai interest dispute.

The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error.
