The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

What to do about it: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

Circular No. 201/13/2023-GST · 2023-08-01

CBIC clarified that where a director rents out immovable property to the company in his personal capacity rather than as a director, the reverse charge entry for director's services does not apply and the ordinary forward charge rules govern. It also clarified that supply of food and beverages in cinema halls is taxable as a restaurant service at five per cent without input tax credit, unless the sale of the ticket and the food are clubbed as a composite supply with the ticket as the principal supply.

What it means for you: Companies paying rent to a director for personally owned premises need not discharge reverse charge under the director's-services entry, but must check the landlord's registration status.

Remember that aggregate turnover for the threshold is computed by clubbing all businesses under the same PAN. Alternatively, GST law permits you to take separate registrations for separate places of business in the same state if you prefer independent billing and returns, though each GSTIN then carries its own full compliance calendar.
Our Adyar factory hires lorries through a transport agency. Who pays the GST?
Under the reverse charge entry, when a GTA that has not opted for forward charge provides service to specified recipients, the recipient pays the 5 percent tax. Specified recipients include factories, registered persons, body corporates, partnership firms including AOPs, co-operative societies and casual taxable persons. How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Missing the window means remaining under the default reverse charge mechanism for the whole year.
Which everyday goods now attract 5 percent GST?
The 5 percent slab now covers most household essentials that earlier fell in the 12 or 18 percent brackets: soaps, shampoos, toothpaste and toothbrushes, hair oil, bicycles, kitchen utensils and tableware. Packaged foods such as butter, ghee, cheese, namkeens, sauces, pasta, biscuits and chocolates are also at 5 percent, as are most medicines, medical devices and agricultural machinery. Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in Adyar use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
What happened to the old 12 percent and 28 percent GST slabs?

Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed.
