Notification No. 33/2020-Central Tax · 2020-04-03
CBIC waived the late fee for furnishing the outward supply statement in Form GSTR-1 for the months of March, April and May 2020 and for the quarter ending 31 March 2020, provided the statement was filed on or before 30 June 2020. The relief covered both monthly and quarterly filers. Because GSTR-1 late fee is separate from GSTR-3B late fee, this notification had to be issued in addition to the GSTR-3B waiver of the same date.
Practical effect: A Chennai supplier who filed the March to May 2020 GSTR-1 by 30 June 2020 owes nothing by way of late fee, whatever the portal ledger may currently show.
GSTN Advisory dated 31 August 2023 — Electronic Credit Reversal and Re-claimed Statement · 2023-08-31
GSTN introduced the Electronic Credit Reversal and Re-claimed Statement on the portal to track credit reversed in Table 4B(2) of GSTR-3B and later reclaimed in Tables 4D(1) and 4A(5). It applied from the August 2023 return for monthly filers and from the July to September 2023 quarter for quarterly filers. The cumulative opening balance of reversals awaiting reclaim had to be reported by 30 November 2023, with up to three amendments allowed until 31 December 2023. The portal now warns when reclaimed credit exceeds the available balance.
What to do about it: Maintain a running register of credit reversed and reclaimed, because the portal flags excess reclaims and the data feeds departmental scrutiny.

An advertising agency was charged value added tax on the entire consideration although service tax had already been paid on the design element. The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.
Practical effect: For Chennai agencies, printers and works contractors, the goods and service components of a composite contract should be clearly valued in the agreement and the invoice so that only one tax attaches to each element of value.
