Exercising its powers under Article 142, the Supreme Court directed that the period from 15 March 2020 to 28 February 2022 shall stand excluded in computing limitation for any suit, appeal, application or proceeding, whether under general law or any special law. Where the balance limitation remaining was less than ninety days, a fresh period of ninety days from 1 March 2022 was granted. Statutory authorities were bound by this direction.

This notification granted a de minimis exemption where the aggregate value of such supplies received from all unregistered suppliers did not exceed Rs 5,000 in a day. The exemption proved unworkable in practice and section 9(4) was soon suspended altogether.

Confiscation follows in MOV-10 and MOV-11.
