CBIC clarified three recurring place-of-supply questions. For transportation of goods, including by mail or courier, where the supplier or the recipient is outside India, Section 13(9) of the IGST Act stood omitted from 1 October 2023, so the place of supply is now fixed by the default rule in Section 13(2), namely the location of the recipient. For advertising services supplied to a government body, the place of supply follows the location of the recipient under Section 12(2) rather than the location of the hoardings, with State-wise allocation where the contract provides for it. For co-location of servers in a data centre, the supply is a bundle of hosting services and not a letting of immovable property, so the recipient's location governs.

P. Karuppaiah v. State Tax Officer (Main) — Madras High Court (Madurai Bench), W.P.(MD) No. 18967 of 2022, decided 22 August 2022 (M. Nirmal Kumar J.) · 2022-08-22
The registration was cancelled for non-filing of returns during the pandemic without giving the dealer a personal hearing. The Madras High Court quashed the cancellation as a breach of natural justice and reinstated the registration, observing that no useful purpose would be served by keeping such taxpayers outside the GST regime. The dealer was directed to file the pending returns and pay tax with interest and penalty within forty-five days, with safeguards on the use of input tax credit.
What to do about it: Cancellation carried out without hearing you is challengeable, and Tamil Nadu courts have consistently preferred bringing dealers back into the system.

To back up the registration processing instruction, CBIC required every CGST Zone to publicise a dedicated email address for registration grievances on its website and on the notice board of the concerned office. Applicants aggrieved by improper queries, unjustified rejection or delay may write to that address with the application reference number; the zone must examine the grievance, take corrective action and report the disposal to the Directorate General of GST periodically.
Practical effect: A registration rejected on flimsy grounds need not go straight to appeal; the zonal grievance email often gets the application reopened far faster.
