Goodwill Industrial Canteen - AAR Tamil Nadu, Order No. TN/09/AAR/2018, dated 30 August 2018 · 2018-08-30

The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

What to do about it: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

Registration cannot be cancelled from a back date without notice of that intention

Aryan Timber Store v. Sales Tax Officer, Class II/AVATO, Ward 62 — Delhi High Court, judgment dated 18 January 2024 · 2024-01-18

The registration was cancelled with retrospective effect from a date long before the show cause notice, and the notice itself never proposed retrospective cancellation. The High Court held that retrospective cancellation cannot be mechanical; the officer must have objective material, must put the taxpayer on notice of the intention to cancel from a back date, and must consider the consequence that customers lose their input tax credit. The cancellation was confined to the date from which the taxpayer had sought cancellation.

Practical effect: If your registration was cancelled from a back date, check whether the show cause notice ever mentioned retrospective effect — that omission alone has repeatedly got such orders modified.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?

The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
The GST department has issued me a summons under Section 70. Is it serious?
Yes, a summons should never be ignored. Under Section 70 the officer has the powers of a civil court, and the inquiry is a judicial proceeding. You must appear on the given date and time with the documents listed, and your statement will be recorded. Non-appearance can invite penalty and, in extreme cases, prosecution. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
