CBIC Instruction No. 03/2025-GST · 2025-04-17

Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Circular No. 179/11/2022-GST · 2022-08-03

The Board settled several goods classification disputes following the 47th GST Council meeting. It confirmed that electrically operated vehicles attract the five per cent rate whether or not they are fitted with a battery pack at the time of supply, and that treated sewage water is exempt because the exclusion for purified water does not extend to it. Rates on fly ash bricks and blocks and on certain by-products of milling of pulses were also clarified.

The 55th meeting reduced GST on fortified rice kernel (FRK) to 5 per cent regardless of end use, supporting public distribution fortification programmes. Gene therapy was fully exempted from GST, a major relief for patients of ultra-expensive treatments. Autoclaved aerated concrete (ACC) blocks containing more than 50 per cent fly ash content were classified under HS 6815 at 12 per cent. The Council also reduced the rate of compensation cess to 0.1 per cent on supplies to merchant exporters, bringing it on par with the concessional 0.1 per cent GST rate on such supplies.

For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. Without this mapping, recovery notices can continue despite full payment, so businesses in Ambattur with paid-but-open demands should file DRC-03A promptly.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. The recognition of the qualification under Indian law is the decisive test, not the subject taught.

If your business is a body corporate or partnership firm, sponsorship services received are notified under Section 9(3) and you must pay 18 percent GST under reverse charge, with ITC available since sponsorship is a marketing expense. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
I buy electronics stock from distributors in other states. How does the IGST on purchases work for me?
Inter-state purchases carry IGST, which flows into your GSTR-2B once the distributor files GSTR-1, and it is fully available as input tax credit. When you sell locally in Tamil Nadu you charge CGST and SGST, and the law lets you use IGST credit against both, with the portal applying the set-off order automatically. There is no cost disadvantage in buying from out-of-state distributors, provided they are compliant filers; a distributor who files late delays your credit by a month. The GST rate on my product changed. Which rate applies to pending orders and invoices?
