Many taxpayers had inadvertently filed a nil refund application for a period and category even though they had a genuine claim, and the portal then blocked any fresh claim for that period. CBIC allowed such applicants to file a fresh refund application for the same period and category, subject to two conditions: the earlier nil claim must have been filed for that period under that category, and no refund claim under that category must have been filed for any subsequent period.
Why this matters: A nil claim entered by mistake is not fatal, but the correction must be made before you file a claim for a later period in the same category.
Union of India v. Cosmo Films Ltd — Supreme Court, judgment dated 28-04-2023 · 2023-04-28
The Supreme Court set aside the Gujarat High Court and upheld the validity of the pre-import condition attached to the IGST and compensation cess exemption on imports under advance authorisation. Exporters who did not satisfy the condition had to pay the IGST. However, the Court directed that a facility be provided to enable such exporters to claim input tax credit or refund of the IGST so paid, so that no genuine exporter suffers a permanent loss.
What to do about it: Chennai exporters using advance authorisations must comply strictly with scheme conditions and, where duty has been paid, follow up on credit or refund entitlement.
Notification No. 1/2017-Integrated Tax (Rate), dated 28 June 2017 · 2017-06-28
Every central tax rate notification for goods has an integrated tax twin carrying exactly double the central rate, because IGST on an interstate supply equals CGST plus SGST. A schedule entry at 9 per cent central tax therefore appears at 18 per cent in the integrated tax notification. State GST notifications issued by the Tamil Nadu Commercial Taxes Department replicate the central schedules word for word, so the rate on a product is identical whether the sale is within Chennai or to another State.
What it means for you: Do not look for a different rate on interstate sales; only the head of tax changes, so a Chennai seller charges IGST at the same combined percentage on a supply to Bengaluru.
