The explanation deeming seventy per cent of a composite project contract to be the value of goods has been carried forward unchanged.

An exporter's refund of IGST paid on exported goods was withheld on the ground that it had claimed duty drawback at the higher rate. Following the Gujarat High Court's Amit Cotton Industries ruling, the Madras High Court held that claiming drawback does not disentitle the exporter to refund of IGST paid on exports, and directed the customs authorities to process the refund along with applicable interest, since the circular relied upon by the department could not override the statutory refund right.
Why this matters: Exporters from Chennai whose IGST refunds are stuck over drawback objections should press this jurisdictional precedent for release of refunds with interest.

Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.
Why this matters: This process produced the Kerala flood cess of 2019, the only State-specific GST cess so far, and set the template for how any similar Tamil Nadu levy would have to be approved.
