In 2021 the Supreme Court had held in Canon India that a demand notice under Section 28 of the Customs Act could be issued only by the officer who originally assessed and cleared the goods, so notices issued by the Directorate of Revenue Intelligence were without jurisdiction. Allowing the department’s review petition, the Court recalled that decision on 7 November 2024. It held that the earlier ruling had overlooked relevant statutory provisions and notifications, and concluded that DRI officers are competent proper officers under Section 28. Demands earlier quashed on the Canon India ground were revived and directed to be decided afresh on merits.
How we apply it: Chennai importers who obtained relief only on the Canon India jurisdiction point must now be ready to defend those customs demands on merits; the identity and jurisdiction of the issuing officer is still worth checking, but this particular ground no longer survives.

Sponsorship services supplied by any person to a body corporate or partnership firm located in the taxable territory were placed under reverse charge, so the sponsor paying for naming rights, event branding or team sponsorship had to discharge the tax. The entry has since been narrowed: on the recommendation of the GST Council at its 55th meeting, sponsorship services supplied by body corporates were moved to forward charge, leaving reverse charge to apply mainly where the sponsorship provider is not a body corporate.
What it means for you: A Chennai company sponsoring a sports event or cultural programme must check whether the organiser is a body corporate before deciding to pay under reverse charge or accept a tax-charged invoice.

The Council devoted an entire meeting to the concerns of micro, small and medium enterprises, noting that roughly five crore MSME units employ about twelve crore people. It constituted a Group of Ministers on MSME convened by the Union Minister of State for Finance, directed the Fitment, Law and IT Committees to examine MSME issues raised by States and field formations and report to that Group within two months, and required that relief already granted to the sector be documented and publicised.
What to do about it: Several later reliefs for small business, including higher registration thresholds and the composition scheme for service providers, trace back to the process started at this meeting.
