The appellate authority had rejected refund claims for August and September 2017 on the basis of a departmental circular. The Madras High Court set aside that rejection, holding that Section 54(3) of the GST Act permits an exporter to opt either for duty drawback or for refund of accumulated input tax credit, and that a circular cannot override the statutory provision. The authority was directed to process the refunds within six weeks.
What to do about it: An exporter's choice between drawback and ITC refund is a statutory right, and a departmental circular is not a valid ground to refuse the refund.

CBIC clarified that transactions in vouchers are neither a supply of goods nor of services. Where a voucher is dealt with on a principal-to-principal basis, no GST arises on its sale or distribution. Where a distributor acts as an agent for a commission, GST applies on that commission. Additional services such as marketing, customisation and technology support are taxable at eighteen per cent, and unredeemed vouchers, or breakage, do not attract GST as no supply takes place.
Why this matters: Retailers and platforms issuing gift vouchers should charge GST only on the underlying goods at redemption and on any commission earned, not on the voucher sale itself.

Acting under Section 168A, CBIC extended the time limit for issuing orders under Section 73 in respect of the financial year 2017-18 to 30 September 2023. It also directed that the period from 1 March 2020 to 28 February 2022 be excluded when computing the limitation for issuing a demand order for an erroneous refund, and when computing the two-year period for filing a refund application under Section 54 or Section 55. The exclusion applies automatically and does not require any application.
Why this matters: A Chennai exporter whose refund claim looks time-barred should recompute after excluding two full COVID years, as many apparently dead claims are in fact still alive.
